Terms of Service

These are the terms for using Orbito. Short version: play nice, respect other people's location, don't try to break the app.

1. What Orbito is

Orbito is a mobile app and web service operated by Orbito Inc. that lets you share your location with a private group of family and friends, on the condition that they also share it with you. Every location check is logged and visible to both sides.

2. Accepting these terms

By creating an account or using Orbito, you agree to these terms and our Privacy Policy. If you don't agree, don't use the app.

3. Who can use Orbito

• You must be at least 13 years old (or the age required to sign contracts in your country, whichever is higher).
• Parents may invite children under 13 into a Family Circle with parental consent — details in the Family plan.
• You must give us accurate account details. Impersonating another person is not allowed.

4. Consent-first location

Orbito is built on the idea that you should only share your location with people who have your permission — and vice versa. You agree:

• Not to add anyone to a Circle or Constellation without their explicit consent.
• Not to use Orbito to stalk, harass, or track someone against their will.
• Not to circumvent Ghost Mode, the Ledger, or any other privacy control.

Violations of this section may result in immediate account termination and, in serious cases, referral to law enforcement.

5. Subscriptions

• Free tier is, well, free — indefinitely.
• Plus ($4.99/mo) and Family ($8.99/mo) are auto-renewing subscriptions. Yearly plans give a 20% discount.
• Payments processed by Stripe (web/Android) or Apple (iOS via App Store).
• iOS subscriptions renew via your Apple ID. Manage or cancel at Settings → Apple ID → Subscriptions at least 24 hours before the next billing period.
• Web/Android subscriptions can be cancelled from your Profile → Manage subscription.
• Refunds: within 14 days of purchase or renewal, no questions asked. Contact billing@orbito.life. For iOS purchases, refunds are handled by Apple per their standard policy.

6. Acceptable use

Don't do any of the following:

• Reverse-engineer, decompile, or attempt to derive source code from Orbito.
• Scrape, mirror, or resell the service.
• Send Pings or invites in bulk to strangers (spam).
• Use Orbito for illegal purposes or to violate anyone's rights.
• Interfere with the app's security features (rate limits, auth, Ledger).

7. Your content

Any text you set as your status, place name, or Ping reason is your responsibility. You retain ownership; you grant us a limited license to store and display it to your Circle. Don't post content that is illegal, defamatory, or infringes someone else's rights.

8. Account termination

• You can delete your account any time from Profile → Delete my account. It's immediate.
• We may suspend or terminate your account if you violate these terms, especially the consent-first rule.
• Termination doesn't refund pre-paid subscription time except where required by law.

9. Service availability

We aim for 99.9% uptime but don't guarantee it. Location data is delivered "as-is" and may be delayed or inaccurate depending on your device's GPS. Orbito is not a substitute for emergency services — always dial 911 (or your local equivalent) in an emergency, in addition to any Orbito SOS.

10. Limitation of liability

To the extent permitted by law, Orbito's liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months prior to the claim. We are not liable for indirect, incidental, or consequential damages.

11. Changes to these terms

We may update these terms occasionally. Material changes will be notified by email at least 30 days in advance. Continued use after the change means you accept the new terms.

12. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules. Any disputes must be filed in a court of competent jurisdiction in Delaware.
